The number of data breach class actions filed in H1 that began the settlement process leveled off during the first half of the year, putting at least a temporary end to the sharp drop-off in these cases that began in H2 2024.
In H1, 212 data breach class actions that were filed during this period started settlement proceedings. This was the lowest number since at least H1 2022, according to Bloomberg Law’s Privacy & Data Breach Class Settlement Docket — but barely. H2 2025 saw 218 data breach class actions entering into settlement negotiations.
For comparison, there were 254 such cases in H1 2025, and 330 such cases during the same period in 2024.
Data breach class actions often involve lengthy and procedurally complex litigation, including class certification, discovery, settlement negotiations and trial. Settlement is a common mechanism for resolving claims and providing relief to affected class members.
There’s little indication that the number of these kinds of class actions filed in courts are decreasing. However, fewer of these types of cases have initiated the settlement process in the past few years. The decline may indicate that data breach class actions are taking longer to reach the settlement stage. Other possible explanations include longer discovery periods, delays in class certification, more contested litigation, or changes in parties’ willingness to settle.

2. Scroll down to the Privacy & Data Breach Class Settlement Docket and click on it.

The dockets capture data breach class actions filed within a specific date range that entered the settlement process during this period.
3. Remove the two selected filing types by clicking on the “x”. (These filters capture cases that have court-approved settlements so removing them allows the search to capture cases that have only begun the settlement process.)

3. Narrow the search results by date. On the drop-down menu for the date filter, select the “Date range” option and select the date range of “01/01/2026 – 06/30/2026″ in the calendar display. Repeat the search for any other desired date ranges.
4. Next, scroll down the filters column until the “Class Action” filter and select “Potential Class Action.
5. To download the results, select the download icon above the list of results and select a format. The results show the number of cases, the parties, where the case was filed, the assigned judge, any resolution and, if available, the cause(s) of action.

The resulting data can be used to quickly and efficiently identify and track relevant cases.
