Flagstar Financial, formerly known as New York Community Bank (NYCB), has agreed to a $1.23 million settlement resolving a class action lawsuit over alleged unfair multiple ATM fees and retry non-sufficient funds (NSF) fees.
The settlement covers individuals who held checking accounts with New York Community Bank and were charged retry NSF fees or overdraft fees on check or automated clearing house (ACH) payments from March 2, 2017, to January 1, 2020. It also applies to those charged multiple out-of-network ATM fees on withdrawals preceded by a balance inquiry between August 20, 2020, and February 20, 2024.
The lawsuit claimed NYCB improperly charged multiple fees on the same ATM transactions and check payments, in violation of customer agreements. While the bank has not admitted wrongdoing, it agreed to the settlement to resolve the dispute.
Settlement payouts will be proportional to fees charged on NSF and overdraft transactions. For ATM fee allegations, affected customers will receive a flat payment of $25. Current account holders will get credits directly to their accounts, while former customers will receive checks.
No claim forms are required; eligible account holders will automatically receive benefits unless they opt out. The deadline to exclude or object to the settlement is December 15, 2025. A final approval hearing is set for January 13, 2026.
NYCB rebranded as Flagstar Financial in 2024 after acquiring Flagstar Bank in 2021, operating branches nationwide from its New York base.
Affected customers can check eligibility and settlement details through official settlement notices and the designated claims website.
