TransUnion, Equifax, Experian class actions allege credit reporting errors – Top Class Actions
Three new class action lawsuits accuse TransUnion, Equifax and Experian of misreporting an account on consumer reports that had been properly discharged in bankruptcy.
Plaintiff Dennis Goyette filed the complaints after discovering the three credit reporting agencies continued reporting joint credit card accounts as past due, despite the account being discharged in his and his wife’s joint Chapter 7 bankruptcy.
Goyette and his wife, Peggy Goyette, filed a joint Chapter 7 bankruptcy on or about Dec. 26, 2024, and received a discharge on or about April 8, 2025, which included their Achieva Credit Union account.
According to the complaints, Goyette’s reports with all three agencies reflected the grant of his bankruptcy petition generally, but each agency separately continued reporting the Achieva account as past due rather than discharged. The Experian complaint further alleges the agency listed the account as “closed at consumer’s requests.”
Goyette claims the same Achieva account, however, was reported correctly as discharged in bankruptcy on Peggy Goyette’s consumer report with each of the three agencies.
“The fact that the same account, included in the same bankruptcy, is being reported two different ways by TransUnion plainly elicits that it does not have the adequate policies and procedures in place to ensure that it prevents such logically inconsistent and inaccurate information from being reported on consumers’ reports,” the credit reporting class action lawsuits say.
Goyette claims TransUnion, Equifax and Experian violated the Fair Credit Reporting Act (FCRA) by failing to maintain reasonable procedures regarding the accuracy of its consumer reports.
All three credit reporting lawsuits raise identical allegations against each respective agency, claiming each “fails to have reasonable procedures to ensure the accurate reporting of joint accounts associated with joint bankruptcy filings.”
Goyette alleges the inaccurate credit reporting unfairly lowered his credit score and caused him embarrassment, frustration, emotional distress and anxiety each time his credit was reviewed.
Each lawsuit seeks to represent a nationwide class that includes consumers who, within two years of filing, had a joint account reported by that agency as not discharged in bankruptcy, while the same account was correctly reported as discharged on the other joint accountholder’s report.

I have had an issue for the past 2 years, around approximately August or September (somewhere in the fall months) where one of the credit bureaus ( TransUnion or Experian) keeps reinserting creditors and accounts that were charged off in a chapter 7 bankruptcy in November of 2020. I called the credit card company that raised the rate and fee, explained to them…they didn’t want to hear it as they said it was information in my credit report so I’ve been paying a bit more due to this repeated deceitful practice. I felt defeated. I pray I don’t have to go through this again this fall but am expecting it. I wondered how this was happening..didn’t realize many more were dealing with deceitful actions from these companies.

Prepaid amount of 600.00 and this was after trying to retrieve any and all monies for 2.to 3 years and was not successful they told me that after the closed my acct without notice until 4 days before and not to my text or regular email it went to spam mail and sat until the day they closed my account and all y. Money was tied into it including 500.00 I recd from a class action for kotex and also a 50.00 referral bonus they gVe to me the day they closed my acct And never released any of my money after 7 mos I hot back 173.00 .. not the 600.00 I put as a deposit to build my credit use for emergency not the 680.00 in my checking account or the 200.00 in savings either or any other deposit except the 173.00 for another class action payout I found out the Albert acct was attached to my chime would show all transactions even after acct closed and. All 3 saving , checking, credit builder card as. Well And so I have proof still since 10/04/2020 and have just now gotten a call from the department of banking and financial office after almost 6 years and now it says I have 800.00 limit on credit builder with nothing owed but 2 yrs after they closed the acct it was their supervisor that told me that 2 months after the acct was closed and my cards were locked out and turned off they allowed a transaction for $594.82 I asked why after 2.months and 15 days later they said sometimes it takes that long for a transaction to process…. Hmm I was never able to do any transactions I tried Spent days and. Weeks trying to get my money back .. calling daily for month after month Csr’s would have me running to ATMs and shutting the card in to allow for transfers or debit or withdrawals and nothing I was broke for a few months that was a huge set back and I couldn’t pay my bills it was also during the first year of COVID and I was not working at the time I couldn’t … And these credit bureaus were still all 3 reported incorrect and still do now they took off the 600 00 after 2 yrs and then put it right back. Saying it’s now $i800 00 … Can u sue them still and all the credit report offices? That’s Alot of money to lose and to never get it back. !

I had my identity stolen in March 2020. Reported it to all 3 bureaus. Reported to all 3 about accounts and people on all 3 bureaus that were not mine and people that I didn’t know. All told me they would investigate and then told me after their investigations that they wouldn’t change anything on my reports. i filed a chapter 7 almost 3 years agao and experian is showing all 8 accounts included and discharged as negatives which including my bankruptcy is killing my score they have the tradelines correct o owed and discharged but they have a section where they say potentially negative and list those accounts.
On my credit report all 3 agencies report are not the same they all have discrepancies that I’ve disputed. Such as addresses, payments, collections dispute, and the list goes on not one time all three reporting agencies has had my score about the same instead I keep losing points when I’m paying everything on time my scores are much lower the highest score I had was a s
6 72 and now I’m at 542. I disputed inquiries that weren’t mine especially when they open up another town that’s not here my birthday has been wrong I’m so tired. And these agencies are supposed to help us keep grounded count me in on this lawsuit

I had my identity stolen in March 2020. Reported it to all 3 bureaus. Reported to all 3 about accounts and people on all 3 bureaus that were not mine and people that I didn’t know. All told me they would investigate and then told me after their investigations that they wouldn’t change anything on my reports.
